Conventional loans · Fannie Mae B2-1.5-04Can you waive escrow on a conventional loan?

A Fannie Mae first mortgage generally provides for escrow deposits to pay taxes, ground rents and property and flood insurance premiums as they come due, and escrow for borrower-purchased mortgage insurance is mandatory. In a condo, co-op or PUD whose association carries a blanket insurance policy, the unit's property and flood insurance does not need to be escrowed. If a special assessment was not paid at closing, the monthly payment must build up enough to pay it when due. Fannie Mae recommends escrow, especially for first-time homeowners and borrowers with blemished credit, but unless the law requires an escrow account, the lender may waive it for an individual loan – the standard escrow clause stays in the loan documents so it can be enforced later. The lender must have a written policy for waivers, and that policy cannot rest on the loan-to-value ratio alone: it must also consider whether the borrower can handle lump-sum payments of taxes and insurance. Escrow cannot be waived for borrower-purchased mortgage insurance or for certain refinances that finance taxes. Separately, federal rules require an escrow account for higher-priced mortgage loans.

What is normally escrowed

  1. Standard

Real estate taxes, ground rents, property and flood insurance premiums.

  2. Always

    Borrower-purchased mortgage insurance premiums.

  3. Condo, co-op, PUD

Not the unit's property or flood insurance when the association has a blanket policy.

  4. Special assessment

If not paid at closing, the payment accrues enough to pay it when due.

When a waiver is possible

  • The law does not require escrow (higher-priced mortgage loans do).
  • The lender's written policy allows it – based on the borrower's ability to pay lump sums, not LTV alone.
  • Not for borrower-purchased mortgage insurance or refinances that finance taxes.
  • The escrow clause stays in the documents, so escrow can be required later.

What the TC can do

  • If the buyer wants no escrow, have them ask the lender early – some lenders charge for a waiver or decline it.
  • On a condo or PUD, get the association's blanket insurance certificate to the lender.
  • Make sure any unpaid special assessment is on the settlement statement or in the payment.

Can I waive escrow if I have PMI?

Escrow for borrower-purchased mortgage insurance premiums is mandatory and cannot be waived.

Do condo owners escrow homeowners insurance?

Not for property or flood insurance when the association carries a blanket policy covering the project.
