Delaware · 25 Del. C. §§2111, 2114, 2120Delaware mortgage satisfaction: 60 days, the demand notice and the attorney's affidavit
When the debt secured by a Delaware mortgage is satisfied, the legal holder at that time must, within 60 days after satisfaction – including payment of any required satisfaction fees – have the satisfaction entered on the record, by recording a satisfaction piece in the statutory form or an attorney's affidavit; the fee is the debtor's unless the mortgage says otherwise (25 Del. C. §2111(a)). If the holder doesn't, the mortgagor or its agent may send a demand notice by certified or registered mail, return receipt requested, to the address in the payoff statement – or, if there's none, to the holder's last address used in writing, attention "Mortgage Satisfaction Department" – with a copy to its Delaware registered agent (§2111(d)). A holder that willfully fails is fined up to $1,000 for each failure (§2111(e)), and any default makes it liable for damages of $10 to $500, or more if special damage is pleaded and proved (§2114). The entry of satisfaction extinguishes the mortgage (§2113). A Delaware attorney who paid off the debt may, at any time more than 60 days after payoff and on at least 15 days' notice to the creditor, record an affidavit and request with the recorder of deeds to mark the mortgage satisfied (§2120).
