District of Columbia · D.C. Code §42-1904.11DC condo resale certificate: the 10-business-day delivery and the buyer's 3-day review
When a DC condominium unit is resold by an owner other than the declarant, the seller obtains from the unit owners' association and furnishes to the buyer, on or before the 10th business day after the buyer signs the contract, a copy of the condominium instruments and a certificate covering, among other things, the unit's assessment statements, approved capital expenditures not in the budget, the reserves and any earmarked portion, the latest statement of financial condition and current budget, pending suits and judgments, the association's insurance, whether the prior owner's alterations violate the instruments, any leasehold term, and the certificate's date (D.C. Code §42-1904.11(a)). If the documents arrive late, the buyer may cancel in writing before receiving them, but not after conveyance (§42-1904.11(a-1)(1)). Either way, the buyer has three business days after receiving them to cancel in writing and return them – or, if they were furnished before the buyer signed, three business days from signing – and after that, or after conveyance, the right ends unless the parties extend it in a signed writing (§42-1904.11(a-1)(2), (4), (5)). A buyer who cancels gets the earnest money or other deposit back without delay or deduction (§42-1904.11(a-1)(3)). The association's principal officer furnishes the certificate within 10 days of a written request by a unit owner or purchaser (§42-1904.11(b)).
