Connecticut · Conn. Gen. Stat. §49-8Connecticut mortgage release: 60 days after a written request

On satisfaction of a Connecticut mortgage, the mortgagee or a person authorized by law to release it executes and delivers a release to the town clerk where the property is – or, if the mortgagor asks in writing, to the mortgagor or its designated representative – and when it goes to the town clerk, a copy goes to the mortgagor at the same time (Conn. Gen. Stat. §49-8(a)). The release must be executed and delivered within 60 days after a written request sent by registered or certified mail, return receipt requested, to the last-known address, or received by courier or any other means, including electronic, reasonably calculated to deliver it. A mortgagee that fails is liable to anyone aggrieved for $200 for each week after the 60 days, up to $5,000, or the loss actually sustained, whichever is greater, plus costs and reasonable attorney's fees (§49-8(c)).

What the TC can do

  • Calendar a check of the county records for the recorded release.
  • If it's missing, send the written request in the form the statute requires and keep proof of delivery.
