California · DisclosureCalifornia meth lab orders: written notice and a copy of the pending order to every buyer

When a local health officer has issued a methamphetamine or fentanyl laboratory remediation order for a California property, several rules apply until the owner receives the health officer's notice that the property requires no further action (Health and Safety Code §25400.28). Except as the seller disclosure statutes in Civil Code §§1102.3 and 1102.3a otherwise require, the owner must notify the prospective buyer in writing of the pending order and give the buyer a copy, and the buyer must acknowledge receipt in writing (§25400.28(a)). Prospective tenants who have applied must get written notice and a copy of the order and acknowledge it before signing a rental agreement; if the owner doesn't comply, the tenant may void the agreement (§25400.28(b)). A mobilehome, manufactured home or recreational vehicle that is subject to an order can't be sold, rented or occupied until the buyer or tenant and the park owner are told in writing of the lab activity (§25400.28(c)).

What the statutes set

  1. Buyer notice (§25400.28(a))

Written notice of the pending order and a copy of it.

  2. Acknowledgment (§25400.28(a))

The prospective buyer acknowledges receipt in writing.

  3. Tenants (§25400.28(b))

Notice before signing; without it the tenant may void the lease.

  4. Manufactured homes (§25400.28(c))

No sale, rental or occupancy until buyer and park owner are told in writing.
