Arizona · A.R.S. §§12-1281–12-1286, 33-811Arizona right of redemption: six months after a judicial foreclosure, none after a trustee's sale
Arizona has two foreclosure paths with opposite answers. After a judicial foreclosure sale, the same redemption periods as an execution sale apply (A.R.S. §12-1283): the judgment debtor or a successor may redeem within six months after the sale, or within 30 days if the judgment found the property both abandoned and not used mainly for farming or grazing (§12-1282(A)–(B)). If the owner doesn't redeem, junior lienholders may redeem in order of priority, each within five days after the prior period (§12-1282(C)), but only after recording a notice of intent to redeem with the county recorder and delivering a copy to the sheriff within the redemption period (§12-1284). The owner pays the purchase price plus 8%, plus taxes or assessments the buyer lawfully paid, with interest (§12-1285(A)). The sheriff's deed is issued only after all periods have run, and the original is recorded within 30 days after it's executed (§12-1286). After a trustee's sale under a deed of trust, the trustee's deed conveys title absolute without right of redemption (§33-811(E)); the winning bidder pays by 5:00 p.m. the next business day, and the trustee submits the deed for recording within seven business days after payment (§33-811(A)–(B)).

What the TC can do
- Find out whether the seller bought at a sheriff's sale or a trustee's sale – only the first carries a redemption period.
- For a sheriff's sale, put the redemption end date on the deal and wait for the recorded sheriff's deed.
- For a trustee's sale, check that the trustee's deed was recorded.
