Arizona · A.R.S. §§33-1901, 33-1902, 33-1904Arizona rental property registration: what a buyer of a rental files with the county assessor

An owner of Arizona residential rental property – property used solely as leased or rented residential property – must keep on file with the county assessor the owner's name, address and telephone number; for an entity or trust, a named officer, general partner, managing member or trustee; the street address and parcel number; and the year the building was built, and must update the information within ten days after a change (A.R.S. §§33-1901(2), 33-1902(A)). An owner who lives outside Arizona must designate and record with the assessor a statutory agent in Arizona to accept legal service (§33-1902(B)). Residential rental property may not be occupied without the information on file; a tenant may give a written ten-day notice and, if the owner doesn't comply, terminate the rental agreement and get prepaid rent back (§33-1902(C)). For a rental acquired after the notice of assessed valuation and until the next one, a city or town assesses a $1,000 civil penalty plus $100 for each month until compliance, dismissed if the owner complies within ten days after receiving the complaint (§33-1902(E)–(F)). An owner who fails to comply is also subject to inspection until compliance (§33-1904(A)(1)). The assessor may charge up to $10 per registration or change (§33-1902(I)).

What the TC can do

  • When the buyer is purchasing a rental, add the county assessor rental registration as a post-closing task.
  • If the buyer lives outside Arizona, add the statutory agent designation to the same task.
  • Note the ten-day update window for the buyer's records.
