Arizona · A.R.S. §§32-2113, 32-2114, 32-2117Arizona military airport, flight route and earth fissure disclosures

Some Arizona disclosures sit in the public record rather than the seller's form. The real estate commissioner records, in each affected county, a document stating that property in the vicinity of a military airport or ancillary military facility may be subject to increased noise and accident potential, with a legal description of the area (A.R.S. §32-2113). The commissioner also records documents for land under a military training route and land under restricted air space, as shown on the state land department's maps – and records a new document if a route or air space changes and the land is no longer under it (§32-2114). For earth fissures, the department provides the Arizona Geological Survey's earth fissure maps on its website and on request, with a notice that the maps may contain errors and don't replace a professional inspection (§32-2117(A)). A subdivider, owner or licensee who gives a written disclosure of those maps and the website – or includes it in a subdivision public report – isn't liable for acts in connection with disclosing land subject to earth fissures, and isn't liable for disclosures made before a map was posted without actual knowledge of fissures (§32-2117(B)).

The rules

  1. 1. Military airport (§32-2113)

Recorded notice of increased noise and accident potential near military airports.

  2. 2. Training routes and air space (§32-2114)

Recorded notices for land under military training routes or restricted air space.

  3. 3. Earth fissure maps (§32-2117(A))

Posted by the real estate department, with an accuracy notice.

  4. 4. Safe harbor (§32-2117(B))

Written disclosure of the maps and website protects the seller and licensee.

What the TC can do

  • Check the title commitment for a recorded military airport, training route or air space document.
  • Give the buyer a written disclosure of the earth fissure maps and the website, and keep the signed copy.
