Alabama · Ala. Code §§35-4-130–35-4-137Alabama lis pendens record: what a recorded notice of action means for a sale

Each Alabama probate judge keeps a public lis pendens record (Ala. Code §35-4-130). Whoever brings a civil action to enforce a lien on, a right to or an interest in land, or to recover land, or applies for condemnation, must file with the probate judge of each county where the land lies a notice naming the parties, describing the land and briefly stating the nature of the claim; the probate judge records it with the hour and date of filing (§35-4-131(a)). An officer who levies on land files a notice of the levy the same way (§35-4-132). Notices are recorded in full and indexed under each party's name (§§35-4-133, 35-4-134). If the notice isn't entered in the lis pendens record, the action doesn't affect a bona fide purchaser, lessee or mortgagee, or a lienholder, without actual notice (§35-4-135). When the action ends, the court may direct an entry of the result, and the filer must, within 30 days after demand, enter satisfaction on the margin of the record once the claim is satisfied or terminated (§35-4-136). Before judgment in a lien action, the owner can nullify the lis pendens with a bond, approved by the probate judge, in double the land's fair market value (§35-4-137).

The rules

  1. 1. Filing (§35-4-131)

Notice with the probate judge of each county: parties, land, nature of the claim.

  2. 2. Levies (§35-4-132)

An officer's levy on land is recorded the same way.

  3. 3. No notice (§35-4-135)

Bona fide purchasers, lessees and mortgagees without actual notice aren't affected.

  4. 4. Satisfaction (§35-4-136)

Within 30 days after demand once the claim is satisfied or terminated.

  5. 5. Bond (§35-4-137)

Double the fair market value nullifies a lien lis pendens before judgment.

What the TC can do

  • When the title commitment shows a lis pendens, flag it to the agents and the title company at once.
  • If the claim is satisfied or the case ended, ask the filer for the marginal satisfaction – the statute gives 30 days after demand.
  • For a lien claim, ask the title company whether a bond under §35-4-137 is an option.
