Alabama · Ala. Code §§35-8A-316, 35-8A-409Alabama condo resale certificate: the 14-day request, the 15-day delivery and the five-day exit

Under Alabama's Uniform Condominium Act the buyer of a resale unit starts the process: the buyer's written request, made within 14 days after signing the contract, obliges the seller to furnish – before conveyance and within 15 days of the request – the declaration, bylaws, rules and regulations, and a certificate from the association (Ala. Code §35-8A-409(a)). The certificate states the periodic assessment, unpaid assessments and other fees past due or due, the latest balance sheet and income statement, the current budget, unsatisfied judgments and pending suits, the insurance for unit owners, any leasehold term, and restrictions in the declaration on what an owner may receive on sale, condemnation, casualty or termination (§35-8A-409(a)(1)–(9)). The association furnishes it within 10 days of the owner's request, and the owner isn't liable for its errors (§35-8A-409(b)). A buyer who receives the certificate isn't liable after closing for unpaid assessments above its amount, and a buyer who asked on time may void the contract until the information is provided and for five days after, or until conveyance (§35-8A-409(c)). The association's assessment lien ranks ahead of a first mortgage for up to six months of budgeted assessments, and a contract buyer is entitled on written request to a statement of the unit's assessments (§35-8A-316(b), (h)).

The rules

  1. 1. Request (§35-8A-409(a))

Buyer asks in writing within 14 days after signing.

  2. 2. Delivery (§35-8A-409(a)–(b))

Seller within 15 days of the request; association within 10 days.

  3. 3. Exit (§35-8A-409(c))

Contract voidable until five days after delivery, or conveyance.

  4. 4. Buyer's cap (§35-8A-409(c))

No liability after closing above the certificate amount.

  5. 5. Lien (§35-8A-316)

Six months of budgeted assessments ahead of the first mortgage.

What the TC can do

  • Send the buyer's written request within 14 days of signing – without it the five-day exit doesn't apply.
  • Track the seller's 15-day delivery and the buyer's five days after it.
  • Request the association's assessment statement for the settlement figures.
